General Information
GNY Equipment, Inc., warrants equipment it has manufactured against defects in material and workmanship under normal and proper usage for a period of twelve (12) months from the date of shipment.
This express warranty is in lieu of and excludes all other representations made, both expressed and implied.If such equipment should fail through a defect in workmanship or material, and specific written notice of such failure is made to the company within (12) months after date of shipment, the company will either repair or replace defective equipment, F.O.B. its factory, without charge. The company may require of the defective equipment to its factory, with transportation charges prepaid, to establish any claim.
All equipment and accessories not manufactured will be warranted or guaranteed by that manufacturer solely.
The company will not be liable for any expense incurred when repairs or alterations are made outside the company’s factory and without proper and prior written authorization from the company. The company shall not be liable for claims based on breach of warranty or negligence or any other damages including consequential damages, delays, loss of revenue, product or for any expense incurred because of the use, misuse, sale or fabrication of products which do or do not conform to the terms and conditions of the order.
All equipment and accessories not manufactured will be warranted or guaranteed by that manufacturer solely.
| Deliveries: | Deliveries will be made in accordance with the manufacturers listed policy. F.O.B. points and freight charges will vary in accordance with manufacturer’s requirements. |
| Quotations: | Quotations are for prompt acceptance and are subject to change or withdrawal without notice, unless otherwise stated. Clerical errors are subject to correction. Shipping dates are carefully approximated but are not guaranteed. |
| Returned Goods: | Returned goods must be with our prior consent. When the goods to be returned have been filled to the customer’s specifications. we reserve the right to charge handling costs. Goods cut or fabricated to the customer’s specifications may not be returned. |
| Cancellation: | Cancellation of merchandise specially ordered or not regularly carried in stock must be submitted to us in writing. Acceptance will be based upon the terms of the manufacturer. |
| Claims: | Claims for shortages, errors, or corrections must be made upon receipt for goods or invoice. |
| Taxes: | Taxes now in effect or hereafter imposed on any article sold by us will be added to the existing price, unless we have on file a properly executed resale certificate. |
